Case Study Five

Too Close

Erica is contemplating whether or not she should report Ivan’s antics to a shift supervisor because she has finally had enough. Whenever they work together on special projects, Ivan gets close enough to brush against her on occasion. She has told Ivan that he’s a little too close for comfort while he’s assisting her, and he usually apologizes and says it’s due to the lack of space.

Erica believes his excuse is a bit odd because she doesn’t seem to have any issues when other employees are assisting her with similar transactions. Erica believes the invasion of her personal space may be a case of sexual harassment.

How would you classify Ivan’s conduct?

The correct answer is gray area

While Erica believes the invasion of her personal space and bumping is purposeful, considering the working conditions and Ivan’s response, his contact with her could very well be accidental.

In this instance, Erica should report what is happening to a supervisor or HR. This may be an opportunity to discuss appropriate behavior and teach Ivan how to perform escorts without invading the personal space of others within current working conditions.

Purposefully invading someone’s personal space or repeatedly bumping into anyone in an attempt to intimidate, harass, or sexually harass them is strictly prohibited and should be reported immediately.
